Terms of Service

These Terms of Service ("Terms") govern your access to and utilization of all content, products, and structural services available via Ar-Construction Sa operated by Ar-Construction Sa ("us", "we", or "our").

Your access to our construction and architectural services is contingent upon your acceptance, without modification, of all terms and conditions outlined herein and in any accompanying project agreements.

1. Services and Payment

Scope of Services: We agree to provide construction, architectural design, structural engineering, and renovation services as detailed in a formal Statement of Work (SOW) or construction contract, specifying project milestones, deliverables, and timelines.

Payment Terms: The Client agrees to disburse payments for structural services according to the schedule specified in the SOW. Progress payments for active construction phases are due on the stipulated dates. Failure to meet financial obligations may result in temporary project suspension or legal recourse.

2. Intellectual Property

All architectural drawings, blueprints, engineering models, and proprietary design concepts developed by Ar-Construction Sa remain our exclusive intellectual property unless explicitly transferred via contract. Client-supplied property documents remain the property of the Client. The Client grants us a non-exclusive, royalty-free license to utilize such data for the sole purpose of executing the contracted construction project.

3. Client Responsibilities

The Client agrees to grant unobstructed site access, furnish accurate land surveys, and supply required permits or authorizations necessary for our teams to perform construction duties. The Client guarantees the legal right to develop the designated land parcel. Delays in supplying necessary permissions or access may result in project schedule adjustments.

4. Termination

Either party may terminate the agreement with 30 days written notice, subject to settlement for completed construction work and procured materials. We retain the right to suspend operations immediately upon breach of terms, non-payment, or safety violations on the work site.

5. Disclaimer of Warranties

Our construction services are executed in accordance with professional engineering standards. However, Ar-Construction Sa disclaims all implied warranties beyond our explicit structural guarantees, as external environmental factors, subterranean anomalies, and force majeure events can impact physical developments.

6. Limitation of Liability

In no event shall Ar-Construction Sa be held liable for indirect, incidental, or consequential damages, including loss of potential rental revenue, project delays caused by municipal regulators, or unforeseen subterranean site conditions.

7. Jurisdiction and Applicable Law

These Terms and any related construction agreements shall be governed and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.

8. Changes

Ar-Construction Sa reserves the right to modify these Terms at any time. Material updates will be reflected on our platform with appropriate notice prior to taking effect.
